2020 Biennial Reports: Who Needs to Submit?

The Resource Conservation and Recovery Act (RCRA) requires large quantity waste generators to submit a report every two years detailing their hazardous waste activities generated in the year prior. (Some state agencies require annual reporting). This is the Biennial Report or the National Biennial RCRA Hazardous Waste Report.
According to the EPA, qualifying waste generators must submit the Biennial Report form (EPA form 8700-13A/B) to the authorized state agency or EPA regional office by March 1 of every even-numbered year. This means that the next Biennial Report is due by March 1, 2020 and should report activities from calendar year 2019.
Does your organization need to submit a Biennial Report? Yes, if it meets any of the following criteria:
- The site generated, in any single calendar month, 1,000 kg (2,200 lbs.) or more of RCRA hazardous waste; or
- The site generated, in any single calendar month, or accumulated at any time, more than 1 kg (2.2 lbs.) of RCRA acute hazardous waste; or
- The site generated, in any single calendar month, or accumulated at any time, more than 100 kg (220 lbs.) of spill clean-up material contaminated with RCRA acute hazardous waste.
